Use of I am Kind

This app is a personal wellness companion for mood tracking and breathwork. By using I am Kind, you agree to use it for your own personal, non-commercial purposes, and not to attempt to reverse-engineer, redistribute, or repurpose the app beyond what the App Store license permits.

Not medical advice

This app is not a medical device, not a diagnostic tool, and not a replacement for professional mental health care. The content shown in the app, affirmations, breathing guides, and insights, is educational in nature and does not constitute medical advice.

If you are experiencing a mental health crisis or have a medical condition, please consult a licensed clinician. If you are in immediate danger of harming yourself or others, use the Crisis Support link in Settings, call your local emergency number, or go to the nearest emergency room.

AI-generated content

Some content shown to you in I am Kind, up to two affirmations per session when Personalized Affirmations is on, the Reflective theme inference, the weekly and monthly summary, the Year in You annual recap, and the Snapshot PDF summary, is generated on your iPhone by Apple's on-device Foundation Models.

Generative AI output can be inaccurate, generic, or occasionally off-tone. AI-generated lines and summaries are not advice. They are prompts for your own reflection. This app does not represent that any AI-generated content is therapeutic, clinically validated, or appropriate to your particular circumstances. Treat the lines as suggestions you can keep or set aside.

You can disable Personalized Affirmations and Reflective Affirmations at any time in Settings. With both off, I am Kind shows only handwritten affirmations from a curated library and uses no AI generation in your sessions.

Subscriptions (I am Kind Premium)

I am Kind offers optional auto-renewing subscriptions under the name I am Kind Premium. The subscription unlocks the deeper insights surface, pattern detection (state transitions, time-of-day rhythms, weekly cadence, body–mind links, Year in Pixels, vocabulary growth, and the Reflective Affirmations theme map), and the Snapshot PDF export. Sessions themselves remain unlimited and free for everyone, with or without a subscription.

Subscriptions are billed through the App Store using Apple StoreKit. Apple is the merchant of record. The following terms apply, in compliance with Apple's auto-renewing subscription disclosure requirements:

Your content

Anything you write in I am Kind (journal entries, custom affirmations, notes) belongs to you. This app does not claim any rights over your content, and because this app has no servers, there is no remote copy of your content for the app to process, moderate, or disclose.

Warranty disclaimer

This app is provided "as is" and "as available," without warranty of any kind, to the maximum extent permitted by applicable law. This app disclaims all warranties, express or implied, including without limitation any implied warranty of merchantability, fitness for a particular purpose, non-infringement, accuracy, reliability, or that the app will be uninterrupted, secure, or error-free.

Limitation of liability

To the extent not prohibited by applicable law, the makers of I am Kind (including affiliates, officers, employees, agents, and licensors) will not be liable for any indirect, incidental, consequential, special, exemplary, or punitive damages arising out of or in connection with your use of the app, even if we have been advised of the possibility of such damages. Our total cumulative liability arising out of these terms or your use of I am Kind will not exceed the amount you paid to us (via Apple) for I am Kind Premium in the twelve months immediately preceding the event giving rise to the claim, or, if you have not paid us anything in that period, US$50.

Some jurisdictions do not allow the exclusion or limitation of certain damages. In those jurisdictions, the above limitations apply only to the maximum extent permitted by law. Nothing in these terms limits any rights you may have under mandatory consumer-protection laws in your jurisdiction.

Indemnification

You agree to indemnify and hold harmless the makers of I am Kind against any claim, demand, loss, or expense (including reasonable attorneys' fees) arising out of (a) your misuse of I am Kind in violation of these terms, (b) your violation of any applicable law, or (c) your infringement of any third party's rights through your use of I am Kind. We reserve the right to assume the exclusive defense and control of any matter otherwise subject to indemnification by you, in which event you'll cooperate with us in asserting any available defenses.

Dispute resolution

Informal resolution first. Before filing any formal claim, you agree to contact I am Kind at the App Store support address with a written description of the dispute and your contact information, and to attempt in good faith to resolve the matter informally for at least 30 days. Most issues are resolvable at this stage.

Forum. Any dispute that is not resolved informally will be brought exclusively in the courts of the jurisdiction in which the publisher is established, and you and the publisher consent to the personal jurisdiction of those courts.

Class action waiver. To the extent permitted by applicable law, disputes will be resolved on an individual basis only, and not as a class, collective, or representative action.

If you are a consumer in the European Union, the United Kingdom, or another jurisdiction whose mandatory consumer law gives you the right to sue in your local courts or to participate in collective actions, that local law applies and the above waivers do not override it.

Force majeure

I am Kind will not be liable for any failure or delay in performance caused by circumstances beyond our reasonable control, including without limitation natural disasters, acts of war or terrorism, strikes, epidemics, government action, internet or telecommunications failures, App Store outages, or third-party service interruptions.

Severability and waiver

If any provision of these terms is held unenforceable, the remaining provisions will remain in full effect. Failure or delay in enforcing any right under these terms is not a waiver of that right.

Assignment

You may not assign or transfer these terms or any of your rights under them without our prior written consent. We may assign or transfer these terms in connection with a merger, acquisition, reorganization, or sale of assets, with notice to you.

Electronic communications

You agree to receive any communications from I am Kind electronically, including in-app notices, App Store transactional messages, and updates to this document posted at this URL and inside the app.

Entire agreement

These Terms of Use and the Privacy Policy together constitute the entire agreement between you and I am Kind regarding your use of the app, and supersede any prior or contemporaneous understandings on the subject.

Governing law

These terms are governed by the laws of the jurisdiction in which the publisher is established, without reference to its conflict-of-laws provisions. If you are a consumer in the European Union, the United Kingdom, or another jurisdiction with mandatory consumer-protection laws, those laws apply to the extent they grant you more protection than these terms.

Changes

These terms may be updated with future releases. The updated terms will ship inside the app and here, with a new "Effective" date at the top. Material changes will be highlighted in the in-app About screen. Continued use of I am Kind after an update indicates acceptance of the revised terms.
